Information for the processing of personal data

This notice describes how the Website is managed with regard to the processing of personal data of Users consulting it, as well as the data processing practices via this Website. In accordance with Articles 13 (for data collected from the data subject) and 14 (for data not collected from the data subject) of Regulation (EU) 2016/679 (hereafter GDPR), users of this website are provided with the following information, which refers exclusively to the processing carried out via this website and not via other websites that may be visited through links from this one, for which it is recommended that they read the relevant information provided by the respective data controllers. This website and the services that may be offered through the website are reserved for persons over the age of eighteen. Therefore, the Data Controller does not process personal data of persons under the age of 18. At the request of such users, the Data Controller will immediately delete any personal data collected involuntarily.

1. Controller of processed data

The Data Controller reserves the right to appoint a web agency or consultant as Data Processor for the purposes of technical assistance, maintenance, technical management, etc. of this Site, whose contact details may be communicated upon request at the addresses indicated above. The Data Controller and the Data Processor also process users' data through their own in-house data processors, who are specifically appointed with instructions to process such data.

2. Category of data processed and sources of origin
  • Navigation data (The computer systems and software procedures used to operate this website acquire, during their normal operation, certain personal data whose transmission is implicit in the use of Internet communication protocols. This category of data includes IP addresses, the type of browser used, the operating system, the domain name and the addresses of websites from which the user accesses and leaves the site, information on the pages visited by the user within the site, the time of access, the length of time spent on each page, internal path analysis and other parameters relating to the user's operating system and computer environment. This technical/information data is collected and used exclusively in an aggregated and anonymous form. These data are processed for the purpose of enabling and monitoring the correct use of this site, as well as to obtain anonymous statistical information on the use of the same, and are deleted immediately after processing).

We may primarily process navigation data and cookies.


We may also process data voluntarily provided by the user, for example through the contact form or by sending an email communication, including ordinary personal data (identification, personal data, billing data and the like) and, exceptionally, special data as defined by Article 9 GDPR or criminal data as defined by Article 10 GDPR, to the extent strictly necessary for the information request received and subject to the consent of the data subject.


The data could come from automated or voluntary sources, as well as from public sources. For example, it could come from the user's navigation, which could bring information about previous consultations of other sites, including in particular cookies and other similar technologies. Data may also be provided voluntarily by the user or related parties. Other data may come from public sources, such as data processed as part of searches and queries, public databases and the like.

3. Purpose of the treatment

The personal data of users of the website, as described above, will be processed in the manner and form prescribed by the GDPR, for the performance of the website's own functions, with particular but not exclusive reference to the navigation of the pages and the procedures described therein for data collection, contact forms, possible registration/access to the reserved area, subscription to the newsletter and the like. In particular, the personal data provided to the data controller will be processed for the following purposes:

  • to follow up specific requests sent by the User to the Data Controller through the Website and its communication tools (contact form, information request forms, etc.);

  • for informative communications regarding the services of the Data Controller itself, following the request for information sent by e-mail or by filling in the contact form and other communication tools;

  • for possible registration to events organised by the Data Controller and other related activities (e.g. confirmation of participation, notification of any updates or changes to the event, etc.)

  • for other purposes connected or related to those indicated above and, in any case, within the scope of the activities of the website;

 

The data provided in a general manner, including those collected automatically during browsing, will be processed for the sole purpose of identifying and controlling access to the website. This also applies to technical cookies, such as session, functional or analytical cookies, which comply with the requirements established by the Guarantee. In particular, with regard to the latter, it is clarified that they can be assimilated to technical cookies if they are created and used directly by the website. The collection and use of the aforementioned browsing data (without prejudice to the anonymisation of the IP addresses) makes it possible to monitor the performance of the Website and to improve the service provided, thus offering users a better browsing experience. 4. Legal basis of the processing

The processing of personal data is based on the fulfilment of contractual or pre-contractual obligations inherent to the request made by the user (e.g. requests for information on the services provided by the data controller, requests for quotations, etc.) and, where necessary, on the consent given by the free and informed completion of the relevant information fields in the form for the collection and supply of data and, where appropriate, by ticking the relevant box.


It should be noted that filling in the relevant fields of the information request form is an integral part of the request itself and therefore constitutes the fulfilment of a pre-contractual or contractual obligation, depending on the context. Consent may be required at a later stage for the processing of further data. Where necessary, a specific privacy notice (different from this one) will be provided.


In any case, the processing will also be based on legitimate interests, including the right to information, for which we refer to the following paragraph.

5. Legitimate interest of the owner

The processing of personal data is also based on the legitimate interests of the data controller, such as the exercise of its rights in relation to the information society, the provision of contractual services and the carrying out of direct marketing operations (in the manner, by the means and within the period provided for by law).

 

6. Obligatory nature of the provision

The provision of browsing data by users for the above purposes depends on the level of privacy that the user has enabled or disabled in their browser. In some cases, the deactivation may affect the navigation of this website. For certain modules of this website, the provision of navigational data and/or the use of technical cookies is mandatory for the proper functioning of the website itself.


In any case, the provision of some of your personal data is necessary for the structure of the site and its operations. The possible request for other optional data will be preceded by a specific authorisation check. The provision of all other data is optional, depending on the type of information the user wishes to provide to the site.


Without prejudice to the foregoing, for example, it is necessary to provide an email address in order to be able to reply to the request made via the contact form, as well as the other compulsory data marked with an asterisk. The other data are optional.


Failure to provide the data required for the requested action (e.g. the e-mail account via the contact form) will make it impossible for the Data Controller to process the request.

 

Provisions applicable to all treatments

In any case, even where the data subject has given consent to authorise the Controller to pursue all the purposes mentioned in the points above, he/she shall remain free to withdraw it at any time.


We specifically and separately inform you, as required by Art. 21 of the Regulation, that the data subject has the right to object at any time to the processing of personal data concerning him/her carried out for the purposes mentioned above and that, should the data subject object to the processing, the personal data may no longer be processed for those purposes.

7. Any recipients of the personal data

The data may be communicated to companies connected to, associated with or controlled by the Data Controller, as well as to consultants or even third parties acting, also on behalf of the Data Controller, for the performance of services connected to the purposes indicated in this informative note, both within the EU and outside the EU (in the latter case, only subjects complying with the regulations in force).


Browsing and similar data (see above), as well as profiling cookies, including those of third parties (see the Cookie Policy of this website), will be communicated to the respective third parties, unless they directly handle them as Data Controllers.


In any case, the data may be communicated to Data Processors as well as to persons authorised to process the data and duly instructed, always within the scope of the purposes of the processing.

8. Retention period

Data provided voluntarily by the data subject will be stored until the data subject expressly withdraws it, including by means of an action on his/her browser, deletion of cookies, express request or otherwise manifested. In accordance with the principle of proportionality, browsing data will be stored in a form that allows the identification of the data subject for no longer than is necessary for the purposes for which they were collected or subsequently processed.


The above provisions shall not apply in cases where it is necessary to keep the data for a longer period in order to defend or exercise a right or to comply with a legal obligation or a public order.

9. Rights of the interested party

Each data subject has the right of access, rectification, erasure (oblivion), restriction, to be notified in case of rectification, erasure or restriction, portability, objection and not to be subject to automated individual decision making, including profiling, in accordance with Articles 15 to 22 GDPR. These rights may be exercised, in the form and within the terms set out in Article 12 GDPR, by means of a written communication addressed to the Data Controller (see point 10).


The Data Controller will provide an adequate response as soon as possible and in any case within 1 month of receipt of the request.

10. Right to withdraw consent

You can withdraw your consent, where provided, at any time and / or exercise your rights by sending:

  • a registered letter with advice of delivery to the writer with an express request (see the address indicated on the letterhead);

  • an e-mail to the address: baldan88@baldan.it.

11. Complaints

Any data subject has the right to lodge a complaint, pursuant to Article 77 et seq. of the GDPR, with a supervisory authority, which for the Italian State is the Garante per la protezione dei dati personali. The forms, methods and deadlines for lodging complaints are provided for and governed by the national legislation in force. The complaint is without prejudice to administrative and judicial actions which, for the Italian State, may be brought alternatively before the same Garante or before the competent court.

12. Profiling

The personal data provided when navigating this website and, where applicable, when filling in the forms published therein, may be subject to profiling by third parties through the use of third-party cookies.


Profiling allows these third parties, who are autonomous holders of the personal data they process for the purposes of profiling and who are not the owners of this website, to evaluate certain personal aspects of the interested party, in particular his or her preferences, interests and tastes with regard to the pages consulted and the activities carried out, in order to allow these autonomous and different holders to provide the interested party with a more specific service tailored to his or her needs.
